Terms of Service

These Terms of Service ("Terms") govern access to and use of Vouch, a product operated by Verinest ("Verinest", "we", "us", "our"), including our website (verinest.app), APIs, dashboard, and any related plugins (collectively, the "Service"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.
1. Description of Service
Vouch is a subscription API service that provides real-time fraud-risk scoring and identity verification (KYC) for online order and signup events, primarily for hosting and web-service billing platforms (starting with WHMCS). The Service returns a risk decision for each submitted event and, for orders flagged as high-risk, can route the end customer to a white-label identity verification flow provided by our verification partner.
Identity verification is performed by a third-party provider (currently Didit). We do not collect or store raw identity documents; document capture happens directly with the verification provider.
2. Accounts and Eligibility
You must provide accurate registration information and are responsible for safeguarding your account credentials and API keys. You are responsible for all activity under your account and API keys, including that of your own end customers' data submitted through the Service.
3. Subscriptions and Billing
- Paid plans are billed monthly in advance on a subscription basis.
- Payments are processed by Paddle.com Market Limited, our payment provider and Merchant of Record. Paddle handles payment collection, tax/VAT calculation, and invoicing. By subscribing, you also agree to Paddle's Buyer Terms.
- Plans are versioned: changes we make to a plan's pricing or included quota do not retroactively apply to your active subscription unless you upgrade, downgrade, or renew into a new version.
- Usage is metered per unique customer scored within a billing period, not per API request. See the Pricing page for current plan details.
- Fees for scoring usage above your plan's included quota are not charged; requests continue to be served (pass-through). Fees for identity verifications above your plan's included quota may incur overage charges, as described on the Pricing page, because identity verification has a real, per-verification cost to us.
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. See our Refund Policy for details on refunds.
4. Acceptable Use
You agree not to use the Service to:
- Submit data you do not have the right or a lawful basis to process, including sending us personal data unnecessary for fraud/KYC screening.
- Attempt to reverse-engineer, circumvent, or degrade the Service's security, rate limits, or scoring logic.
- Use the Service in connection with an unlawful, fraudulent, or high-risk business without disclosing this to us in advance.
- Resell or provide the Service to third parties without our written consent, other than routing your own end customers through it as intended.
5. Service Availability
The Service, including our WHMCS plugin, is designed to fail open: if our API is unreachable or times out, your order is not blocked. We do not guarantee the Service will be available at all times and are not liable for losses arising from downtime, though we work to keep the hot decision path highly available.
6. Data and Third Parties
Our handling of personal data is described in our Privacy Policy. We rely on sub-processors, including Didit (identity verification) and fraud data enrichment providers, to deliver parts of the Service. We remain responsible for the Service as a whole.
7. Intellectual Property
We retain all rights to the Service, including the underlying software, scoring rules, and branding. You retain rights to your own data submitted through the Service.
8. Limitation of Liability
The Service provides risk signals and decisions to assist your own business processes; it does not guarantee the prevention of fraud or chargebacks, and decisions should not be treated as a sole basis for legal or financial determinations about any individual. To the maximum extent permitted by law, Verinest is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim is limited to the fees you paid us in the three months preceding the claim.
9. Termination
We may suspend or terminate access to the Service for breach of these Terms, non-payment, or unlawful use. You may stop using the Service and cancel your subscription at any time.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the dashboard or email. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of Türkiye, without regard to conflict-of-law principles, unless otherwise required by applicable consumer-protection law in your jurisdiction.
